Easily one of the most difficult practice areas of law, Family Law is a “court of equity.” This means that rather a jury and a lawsuit, you are dealing with only a judge or court commissioner.
Whereas a jury might need to simply decide which car ran a red light and caused a crash, a court of equity may hear all the evidence and not find a sufficient basis to rule. In spite of that, they have to rule anyway. Their ruling will not necessarily be about money damages but instead will be decision making. You take this property. You see this child on these days and times. This person pays that person this many dollars a month for this many years.
A court of equity is a scary thing, in the respect that the judge or court commissioner is merely forming an opinion, and then issuing orders based on the opinion.
