Our appellate practice is open to federal and state court cases.
Going into an appeal, it is important that our clients understand what can and cannot be done on appeal. The two ingredients in most trial courts are law and fact. If a trial court got the law wrong, appeal is a proper solution.
But if the court got the facts wrong, if they merely believed the other side rather than believing you, it is very difficult to overturn that on appeal.
Sometimes you agree with the trial court, and it is the other side that files an appeal. The questions remain the same, but you are now defending the trial court rather than seeking to overturn it.
